Mediation offers a great alternative to a formal lawsuit. There are many advantages to using mediation versus litigation for a dispute. Mediation is also a great way to handle a dispute with someone you are closely involved with such as a friend, family member, boss or neighbor. If you are already in litigation you may take your case to mediation as long as criminal activity is not involved.
Mediation allows each party to speak for themselves rather than conduct everything through attorneys. This makes it possible to settle the dispute within a few hours to a few days and communicate openly to reach a mutual decision. Mediation involves both parties reaching a mutual agreement so there is not a winner or a loser. The decisions reached in mediation are also more often carried out than those mandated by a judge.
A major benefit of mediation is confidentiality. Nothing said in mediation can be used later in a court case unless it involves serious criminal activity or child abuse. The information about mediation is not available to the public and the names of the individuals are protected to ensure privacy. This can be very helpful to repair relationships between the two disputing parties and maintain both parties’ reputation.
Mediation is far less expensive than litigation. Mediation fees are generally far less expensive than attorney fees and mediation involves much less time than litigation. These two factors make mediation reasonable and affordable for both parties. Regardless of how complex your case has become, mediation can still be a reasonable option to reach a settlement and will save time, money and hard feelings that come with a long, drawn-out court case.
